Testosterone Therapy Litigation Continues
Last month, Jacoby & Meyers, Dangerous Drugs discussed the filing of hundreds of claims that are currently pending against multiple testosterone therapy manufacturers. These claims arose after men using testosterone treatments such as gels, patches, pellets and injections experienced adverse cardiac reactions to the treatment. Since June 2014, all testosterone drug federal lawsuits have been centralized in the Northern District of Illinois for coordinated proceedings as part of a Multidistrict Litigation (MDL) in front of Judge Matthew Kennelly.
Judge Kennelly requested the parties work together to coordinate the cases in the MDL and those additional ones that are being filed in various state court systems. On December 4, 2014, a joint status report was filed that detailed the inability of the parties to reach an agreement as to how to coordinate the claims. The disagreements surround the method by which discovery will be conducted and coordinated in the matters.
This topic of coordinating the hundreds of lawsuits that are occurring around the county in Federal and State courts was discussed at the Case Management Conference on December 5, 2014. The Defendants and the Plaintiffs presented their respective coordination proposals. As of December 16, 2014, over 620 cases have been filed in courts throughout the United States.
A decision has yet to be made regarding what coordinated approach the court will select. According to the calendar for the Northern District Court of Illinois, a case management conference is scheduled to occur January 12, 2015 at 1:30pm. While it is unclear what will develop from the case management conference regarding coordinating state-federal cases, it is readily apparent that the number of testosterone therapy injury claims will continue to grow.
